Government Pleural Plaques (Former Claimants) Payment Scheme Now Open

The government compensation scheme to provide lump sum payouts to some people with asbestos-related pleural plaques is now accepting applications.

Thousands will be able to apply for a £5,000 payment, the Ministry of Justice has announced. The previous Labour government was accused of "abandoning" victims after it announced earlier this year that it would not change a 2007 Law Lords ruling that prevents sufferers of pleural plaques - a scarring of the lungs caused by exposure to asbestos - from claiming injury compensation. Instead however, the previous Labour Government announced a range of measures to support people who have been exposed to asbestos. This included for those whose had unresolved personal injury claims opened before the 2007 ruling will qualify for 'extra-statutory' one-off payments of £5,000. The government decision bars new claims for condition however. About 6,000 people in England and Wales are thought to be eligible. They have until 1 August 2011 to lodge a claim, the Ministry of Justice announced.

The TUCwarned claimants against using "claims firms" seeking to capitalise on other people's misfortune." Claimants are strongly advised to contact the Union's Legal Services Department for Legal Advice and assistance rather than 'Claims Direct' type firms or solicitors preying on these claimants.


Closing Date for applicants is 1st August 2011
